المحكمة الاتحادية العليا تقضي بعدم دستورية قرار يمنح أولوية في التعيين ————————— قضت المحكمة الاتحادية العليا اليوم الثلاثاء ١١ شباط ٢٠٢٥ بعدم دستورية قرار مجلس قيادة الثورة (المنحل) رقم (١٩٠) لسنة ٢٠٠١، المتضمن منح أولوية في التعيين في الوظائف الحكومية، لمخالفته أحكام المادتين (١٤) و(١٦) من دستور جمهورية العراق لسنة ٢٠٠٥. وكانت الدائرة القانونية في مجلس الخدمة العامة الاتحادي قد قدمت الدعوى القضائية المرقمة (٢٦٣/اتحادية/٢٠٢٤) إلى المحكمة والطلب منها الحكم بعدم دستورية القرار المذكور. وجاء قرار المحكمة منسجماً مع مسار المجلس ومؤكداً على مبادئ المساواة وتكافؤ الفرص المنصوص عليها في الدستور، ما يعني إلغاء أي امتياز غير دستوري في التعيينات الوظيفية. مجلس الخدمة العامة الاتحادي إرادة دولة … وإنفاذ قانون Supreme Federal Court Declares Unconstitutional Decision Granting Preferential Hiring ———————————————- The Supreme Federal Court ruled on Tuesday, February 11, 2025, that Decision No. 190 of the dissolved Revolutionary Command Council issued in 2001 which granted preferential hiring in government positions is unconstitutional. The ruling was based on the decision’s violation of Articles 14 and 16 of the 2005 Constitution of the Republic of Iraq. The Legal Department of the Federal Public Service Council had filed lawsuit No. 263/Federal/2024 with the Court, requesting that the aforementioned decision be declared unconstitutional.
