🔆 Neurorights: Safeguarding Mental Autonomy
📍 What are Neurorights?
🧠 Neurorights are a proposed set of human rights that protect individuals from the potential misuse of neurotechnologies like Brain-Computer Interfaces (BCIs) and Deep Brain Stimulation (DBS).
📍 The Five Key Neurorights
1️⃣ Personal Identity: Neurotechnology must never alter a person’s sense of self.
2️⃣ Free Will: Individuals must be able to make decisions freely, without neurotechnological manipulation.
3️⃣ Mental Privacy: Data on a person’s brain activity must not be used without their explicit consent.
4️⃣ Equal Access: Enhanced brain capacity through neurotechnology must be made accessible to all.
5️⃣ Protection Against Biases: Individuals must not face discrimination based on data obtained through neurotechnologies.
📍 Global and Indian Context
🌎 Countries like Chile and Colorado have recognized neurorights legally.
📜 In India, existing laws like the Digital Personal Data Protection Act, 2023, Mental Healthcare Act, 2017, and IT Act, 2000 provide a robust framework for safeguarding neurorights. Judicial decisions, such as Justice K.S. Puttaswamy vs. Union of India (2017), affirm mental privacy under the Constitution.
📍 Why it Matters
With the rapid evolution of neurotechnologies, ensuring the protection of mental privacy, identity, and free will is essential for ethical and equitable integration of these advancements into society.
