Context: SC rejected the Lokpal order saying High court judges are not under the jurisdiction of Lokpal. Actually Lokpal has initiated the investigation against HC Judge of Allahabad in relation to favour the private company. Lokpal said that according to section 14 of the Lokpal act Any person who has been holding the position created by the act of parliament is under the Lokpal jurisdiction and HC has been established by the HC Act 1861 and GOI Act 1935. And HC Judges are Public servants and comes under the ambit of Lokpal and Lokayukta act 2013. SC judges are also public servants under the meaning of Prevention of corruption act but outside the jurisdiction of Lokpal as they are the child of the Constitution and does not fall under the meaning of section 14 of the Lokpal act as this section says any person or body created by law or financed by the central government or controlled by it.
