Context:- Independence mad accountability of the Judiciary
In K veeraswami case, SC has said case cannot be registered against judges without consulting CJI. But considers them as Public servants under prevention of corruption act. However the matter of judges will be taken by in house procedure of the court and that also when Chief justice of HC or CJI or President receives complaint. If the charges proves right, then he may be forced to resign or deny them to do any judicial work 😕 but not jail😜.
Only God knows how to infuse accountability in the judiciary, but for our exam we can mention following points:
1. Passing judicial standards mad accountability Bill.
2. Cooling of period for joining politics.
3. Passing NJAC or adopt nay global best model like in USA ( Assessment made by bar council of USA before appointment) and UK.
4. Rules for Recusal in case of any hint of biasness.
