The appellant contended that he and the victim were legally married on 15.06.2022 as per Sikh rites and ceremonies, against the wishes of her relatives.
In response to threats from the victim’s family, the couple filed a protection petition, which was granted by the Punjab & Haryana HC on 21.06.2022. However, the victim later returned to her parental home, prompting the appellant to file a petition u/s 9 of HMA seeking restitution of conjugal rights.
On 01.09.2022, the victim recorded a Section 164 Cr.P.C. statement, alleging that the appellant had forcibly solemnized the marriage and committed rape. She also accused the appellant’s mother and brother of assisting in the alleged crime.
