IAS officer Varnali Deka, then DC of Kokrajhar, Assam, filed a cyberstalking case u/s 354A and 354D IPC against Amit Chakraborty for reacting with smiley emoji to a Facebook comment. In April 2023, Facebook user Naresh Barua commented on Ms. Deka’s photograph, asking, “No makeup today, ma’am?” Amit responded with a smiley emoji, to which Ms. Deka replied, “Why is that your problem?” Later, she lodged a criminal case against 3 individuals, including Amit and Naresh.
