*BREAKING NEWS* Dr Nancy Baraza; Philip Tunoi; Joseph Mutava; Mary Gitumbi; and Said Chitembwe reinstated as Judges after Justice Charles Kariuki of Narok finds that they were unlawfully removed by JSC in the absence of rules to consider petitions against them.
Nancy Baraza, Kenya’s former Deputy Chief Justice (DCJ), was removed from office in 2012 following allegations of misconduct. The main reason for her removal was an incident at the Village Market shopping mall in Nairobi on December 31, 2011.
Baraza was accused of assaulting a security guard, Rebecca Kerubo, by pinching her nose and threatening her with a gun after Kerubo asked her to undergo a routine security check. The incident sparked public outrage, leading to an investigation by the Judicial Service Commission (JSC), which recommended her removal.
A tribunal, chaired by former Tanzanian Chief Justice Augustino Ramadhani, found Baraza guilty of gross misconduct and ruled that her behavior was incompatible with the high standards required of a judge. She appealed the tribunal’s decision.
