President Donald Trump issued an executive order early in 2025 trying to end "birthright citizenship."
Birthright citizenship means that anyone born in the United States automatically becomes a U.S. citizen, no matter the immigration status of their parents. This right comes from the 14th Amendment to the U.S. Constitution, which was added after the Civil War to ensure citizenship for freed slaves and their children.
Trump's order wanted to stop this automatic citizenship for children of people who are in the U.S. illegally or on temporary visas. However, a lower court blocked this order, saying it was unconstitutional. Then, on February 20, 2025, a U.S. appeals court (the 9th Circuit Court of Appeals) agreed with the lower court and refused to reinstate Trump's order. This means the block stays in place for now, and birthright citizenship continues as it has for over 150 years.
This decision could lead to the issue going to the Supreme Court for a final ruling, as Trump's team might appeal again. The debate centers on how to interpret the 14th Amendment, with Trump arguing it shouldn't apply to children of non-citizens, while opponents say it applies to everyone born in the U.S.
