HIGH Court judge, Justice Munamato Mutevedzi, has expressed deep concern over some of the horrific cases presided over by judges, suggesting that the nature of crimes in Zimbabwe may indicate that the world is nearing its end.
The judge also said court officials would require psychological support to cope with the disturbing things they hear daily in court. Mutevedzi made these remarks while sentencing 19-year-old Tapiwa Mereka at the Gweru High Court.
They were found guilty of the gruesome murder of their mother’s sister, Mary Mereka, on January 27, 2023, and for raping her lifeless body. Mutevedzi said Mereka deserved the death penalty but noted that he is fortunate the capital sentence had been abolished.
“If it is true that one day God will destroy the world, then that time is near. Some of the crimes we see suggest that Armageddon is imminent. “Tapiwa Mereka has a head but it is doubtful that he has a brain inside it. If he does, then his mind is so perverted and depraved he should not be living amongst humans. “The crime he committed is unconscionable and would possibly win an Oscar for horror movies.
“Everyone who took part in the trial will be thinking about this for a long time.
“This shows that judges are not inanimate. Judicial officers and court officials who hear these horrific stories daily may suffer vicarious trauma and require therapy in one form or another,” said Mutevedzi. The court heard that Mereka had plotted to rape and kill his aunt for a long time.
In his warned and cautioned statement, the accused admitted he had long admired her and wanted to have sexual intercourse with her.
He bided his time, waiting for an opportunity to act. He said the idea became maddening about three days before the murder and he could not shake the desire.
On the day of the crime, while working in the field with her, he took an axe and struck her three times on the head, then raped her while she was still alive but in a vegetative state.
Afterwards, he dressed her, discarded the axe, and fled to Sebakwe River intending to stay there.
Mutevedzi noted that even if the victim had been dead at the time of the sexual act, it would have constituted the crime of violating a dead body under Zimbabwe’s Criminal Law (Codification and Reform) Act.
He said that in other jurisdictions, this would be necrophilia, criminalizing sexual attraction to a dead person.
“This aggravates the offender’s situation,” said the judge.
Given the severity, the judge ruled that the only suitable punishment was life imprisonment.
“What is worse is that he admitted being prepared to kill for no reason. He is a dangerous individual whom the court cannot risk releasing.
“He may kill again—for no reason other than his own enjoyment.
“He appears worse than a robber who kills for gain because it is possible to resist that more than an inexplicable desire.
“It’s as if he is possessed by an irresistible spirit.
“We find it difficult to empathize with the offender.
“If he could so sadistically kill his own mother’s sister and derive sexual gratification from her helpless state, we shudder to imagine what he could do to strangers or children.
“He is someone whose soul must be left to God’s judgment. The court can only administer justice.
“We will permanently remove him from society and confine him within prison walls. “Accordingly, the offender is sentenced to life imprisonment,” the judge ruled.
