MASVINGO – An airtime vendor based in Masvingo has filed a US$40 000 lawsuit for unlawful arrest against ZRP Commissioner General Stephen Mutamba and the Minister of Home Affairs and Cultural Heritage Kazembe Kazembe.
Michael Zumba was arrested on April 24, 2024 on allegations that he was changing foreign currency and he lost his two-year-old daughter Beauty Matipashe Zumba on May 21, when he was in detention after being denied bail.
Zumba says he was also wrongfully detained, maliciously prosecuted and spent a lot of his money defending the case hence the lawsuit.
According to the lawsuit filed at the Magistrates Court in Masvingo by Zumba’s legal representative, Martin Mureri of Matutu and Mureri legal practitioners on June 6, 2025, Zumba who was found with R20, US$20 and airtime was acquitted by Masvingo Magistrate …….. after spending four weeks in prison.
Magistrate ….. found no basis for his arrest as nothing indicated that he was into changing money.
The defendants in the case are Minister of Home Affairs, Kazembe Kazembe, Police Commissioner General Stephen Mutamba, Detective Constable ……..Dzingirai and Detective Constable ……. Mabheka both of Masvingo Central Police Station. The plaintiff was supposed to serve the papers to the defendants this week.
The basis of the lawsuit is that in April, last year at Yeukai Business Center in Masvingo, Zumba was putting on a bib selling airtime and he was arrested by Mabheka and Dzingirai on allegations that he was changing money. They searched him and found nothing to indicate that he was changing money.
The next day he was taken to court and refused bail and consequently his daughter died while he was in prison.
The breakdown of the damages is US$15 000 for wrongful arrest, US$10 000 for wrongful detention, US$10 000 for malicious prosecution and US$5 000 for defending malicious allegations against him.
“Notice was given to the defendants of the plaintiff’s intention to sue in terms of Section 6 of the State Liabilities Act (Chapter 08:14). The defendants have refused or neglected to pay despite lawful demand. As a result of the defendants’ unlawful conduct, the plaintiff suffered damages amounting to US$40,000.
“The plaintiff prays for an order for the payment of US$40,000 for damages by the defendants, the one paying the other to be absolved, and costs of suit on an attorney-client scale,” reads the application.
