Under the Industrial Disputes Act, 1947 (Section 9A), employers (including govt. departments acting in an employer role) must give notice before changing service conditions like.
1. Salary
2. Working hours
3. Job role
4. Leave entitlements
5. Contractual terms.
6. etc.
👉🏽 *Unilateral Changes Can Be Challenged:*
If a department Changes conditions without consulting employees/unions, or
Ignores existing agreements, or
👉🏽 *then the union can:*
*File a Writ Petition in the High Court citing violation of natural justice and arbitrary action.*
Or
*Challenge it via Labour Commissioner.*
👉🏽 Constitutional & Legal Backing:
1. *Article 14 & 16 (Equality & non-arbitrary treatment in public employment)*
*Conclusion:*
*No, a department should not change service conditions without consultation, especially if Staff are under NHM*
