The case of Braj Nandan Sinha v. Jyoti Narain, reported in (1955) 2 SCR 955, revolves around the fundamental issue of whether a Commissioner appointed under the Public Servants (Inquiries) Act, 1850 is a “court” within the ambit of the Contempt of Courts Act, 1952. Court has been explained in this judgement, court is a body or forum, which must have a power to the decision or definitive judgement which has finality and authoritativeness which are essential tests of a judicial pronouncement if it has to be treated as a court.
