Farbiarz clarified that his ruling applies only to Khalil’s detention and deportation based on the State Department’s claim that he poses a “threat to national security.” Khalil’s detention was also based on other grounds, including alleged omissions on his green card application, which could still justify his continued detention. In light of the way the Trump administration handled the case, the judge added that “the petitioner’s career and reputation are being damaged and his speech is being chilled, and this adds up to irreparable harm.” Khalil has been detained since last March, after being “abducted” by Immigration and Customs Enforcement from outside his home. During this time, Khalil welcomed a newborn baby. In response to the recent news, Khalil’s wife said, “Mahmoud must be released immediately and safely returned home to New York to be with me and our newborn baby.”
