Answers 2 questions
1. Why do the power sector regulator (PUCSL) and the IMF differ on electricity pricing?
2. What can the government and IMF do in response to the view of the independent regulator, without violating the rule of law and without undermining governance?
Short answer: The regulator is using a (sensible) method to get cost reflective pricing; the IMF and government shld not have had a different method. In the event of disagreement, apart from legislation and appeal to the judiciary the rule of law (established by parliament) does not give authority to the executive, and thereby to the IMF, to overrule the independent regulator. Therefore, to prevent undermining governance, IMF conditionality will need to differ to the authority of the regulator within the rule of law.
