Is Mas'ale Mein Sahih Mauqqif Kya Hai? بَيِّنُوا تُؤْجَرُوا۔ ✺ Jawab: Is mas’ale mein sahi mauqqif yahi maloom hota hai ke bhains ki bhi qurbani jayaz hai. Aaimmah-e-salaf o khalaf se yahi manqool hai. Bhains ki qurbani ke jayaz hone ka mas’alah koi naya mas’alah aur nayi tehqeeq nahi hai. ☜ Is mauzuu’ par faazil-e-girami, Maulana Inayatullah Sanabili Hafizahullah ki kitaab *“Bhains ki Qurbani: Ek Ilmi wa Tahqeeqi Jaiza”* nihayat mustanad o tahqeeqi kitab hai, jo internet par bhi maujood hai. ◈ Is kitab ke mutaal'e se maloom hota hai ke: Dasweeñ sadi hijri balke giyarhwiñ aur baarhweeñ sadi hijri tak ke ‘ulama-e-salaf o khalaf, aimmah-e-tafseer, wa aimmah-e-hadees, wa aimmah-e-fiqh, wa aimmah-e-lughat ki tehqeeq aur unka mauqqif yahi hai ke *Jamoos (Bhains)* *Baqar (gaaye)* ki jins se hai, aur yeh usi ki ek nuu' hai. Lafz *baqar*, *jamoos* ko bhi shamil wa mutanawil hai. *Jamoos* bhi *Baqar* ka madlool wa misdaq hai. ◈Guzishta sadiyoñ ke kisi ek bhi mustanad aalim se yeh manqool nahin hai ke jamoos, baqar ki jins se nahi hai, uski ek nuu' nahi hai. ◈ Banabarein kitab o sunnat mein *Baqar* ke baare mein jo hukum hoga, woh *Jamoos (Bhains)* ko bhi shamil wa mutanawil hoga. ◈ Chunanchah zakat ke mas’aleh mein ‘ulama-e-ummat ka is baat par ijma’ hai ke *Jamoos* mein bhi waise hi zakat wajib hai jaise gaye mein hai, donoñ ka nisaab ek hai, donoñ ko mila kar bhi nisaab poora kiya jayega, aur zakat wajib hogi. Is mas’ale mein aimmah-e-salaf o khalaf ke darmiyan koi ikhtilaf nahi hai. ◈ Lihaza isi tarah qurbani ke mas’ale mein bhi *baqar* se muta’alliq jo hukm hoga, woh gaye aur *Bhains* donoñ ko shaamil aur mutanawil hoga, aur is liye gaye ki tarah *Bhains* ki bhi qurbani jayaz aur durust hogi. ◈ Chunanchah guẕishtah sadiyoñ, daswiñ sadi hijri balke giyarhweeñ, baarhweeñ sadi hijri tak ke aimmah wa ‘ulama-e-salaf o khalaf mein kisi mustanad ‘aalim ki yeh tasreeh nahi milti ke bhains ki qurbani najayaz hai, durust nahi hai. ◈ Balke is mas’ale mein aimmah, ‘ulama-e-salaf o khalaf se jo tasreeh milti hai, woh yahi hai ke bhains ki qurbani jayaz aur durust hai. In aimmah wa ‘ulama ke naamoñ ki taweel fehrist aur unke fatawe wa aqwaal ki tafseel ke liye mulahiza ho Maulana Inayatullah Sanabili Hafizahullah ki mazkura baala kitaab. ✺ Zel mein chand mutaqaddimeen akaabir aimmah ke asma-e-girami ke zikr par iktifa kiya jata hai, jinhone *Bhains Ki Qurbani* ko saraḥatan jayaz wa durust kaha hai, tafseel ke liye mazkura kitab padhne ki zehmat ki jaaye: ① Imam Sufiyan Thauri raḥmatullahi alaih (wafat 161H) ② Imam Malik raḥmatullahi alaih (wafat 179H) ③ Imam Ishaq bin Rahwayh raḥmatullahi alayh (wafat 238H) ④ Imam Ahmad bin Hanbal raḥmatullahi alayh (wafat 241H) ⑤ Imam Ishaq al-Kawsaj raḥmatullahi alayh (wafat 251H) ⑥ Bukhari al-Maghrib Imam Ibn ‘Abd al-Barr raḥmatullahi alayh (wafat 463H) ⑦ Imam Abu al-Walid Baaji Andulusi, Shareh Muwatta Maalik raḥmatullahi alayh (wafat 474H) ⑧ Imam Nawawi, Shareh Sahih Muslim raḥmatullahi alayh (wafat 676H) Wa kafā bihim qudwatan. Mazeed naamon ke liye mazkura kitaab mulaahiza ho. ✺ Akaabir ‘ulama-e-Ahl-e-Hadees ki aksariyat bhi bhains ki qurbani ke jawaz ki hi qayil hai, masalan: ① Shaikh al-Kull Miyan Sayyed Muhammad Nazir Hussain Muhaddis Dehlvi raḥmatullahi alaih ② Allama Nawab Siddiq Hasan Khan raḥmatullahi alaih ③ Allama Hafiz Muhammad Gondalwi raḥmatullahi alaih ④ Maulana ‘Abdul Qadir Hisari raḥmatullahi alaih ⑤ Maulana Sanaullah Amritsari raḥmatullahi alaih ⑥ Maulana ‘Abdul Jaleel Samrodi raḥmatullahi alaih ⑦ Shaikh ul-Hadees Maulana ‘Ubaidullah Rahmani Mubarakpuri raḥmatullahi alaih waghairah waghairah. ☜ Zahir hai kisi saahib-e-‘ilm wa baseerat aur ma’qool aadmi ke liye yeh durust nahi ho sakta ke woh in kibaar aimmah-e-salaf o khalaf ke fatwe aur unki yeh tahqeeq to na maane ke *jamoos (bhains)* *baqar* hi ki jins se hai, is ki nuu' hai, aur is ki bhi qurbani jayaz hai. Lekin ‘ahad-e-haazir ke chand ‘ulama ke fatwe aur unki yeh zid zaroor maane ke *jamoos (bhains)* *baqar* ki jins se aur is ki nuu‘ nahi hai, is ki qurbani jayaz nahi.
