Bail is a constitutional entitlement. Every person has the right to it, even persons accused of rape and murder. This is a cornerstone of the presumption of innocence. 2. Moreover, every person has the right to liberty - nobody should be incarcerated for a minute longer than is absolutely necessary. Bail hearings must be heard and determined quickly, without undue delay. Normally, a decision on bail is made on the day of the hearing. The principles are entrenched and easy to apply.
