SC has held that a Judgment of a HC cannot be challenged u/A. 32 of the Constitution and instead have to be challenged u/A. 136 of the Constitution. 2. ⁠The logic seems to be the fact that when a Court exercise its judicial functions, it cannot violate the fundamental rights and is not “the state” under article 12 of the Constitution.
