> Let's Forward this Post Everywhere ❕ *[🌕] From a purely Constitutional perspective, the continued incarceration of Blessed Mhlanga raises a number of concerns.* 1. Bail is a constitutional entitlement. Every person has the right to it, even persons accused of rape and murder. This is a cornerstone of the presumption of innocence. 2. Moreover, every person has the right to liberty - nobody should be incarcerated for a minute longer than is absolutely necessary. Bail hearings must be heard and determined quickly, without undue delay. Normally, a decision on bail is made on the day of the hearing. The principles are entrenched and easy to apply. Even a 2nd year law student could do it. 3. To compound matters, every person has the right to a fair and expeditious hearing before an impartial court. Justice delayed is justice denied. In light of the above principles, keeping Blessed in jail for another night in the circumstances undermines the Constitution, media freedom and his right to a fair trial. He is innocent and should not be persecuted for practicing journalism.
