LUSAKA REGIONAL SURVEYOR COMPLICATES BAOBAB LAND DISPUTE FOR MAHTANI'S COMPANY KWIKBUILD Good evening. Regional Surveyor, Emmanuel Mpange has, for some strange reason, decided to plunge into the disputed Baobab Land issue by calling "squatters" to a meeting to discuss boundaries with a company owned by the Mahtani Group, Kwikbuild Construction Limited. Engineer Mpange has called a meeting of the squatters on Baobab Land's subdivision C, which Kwikbuild Construction firm claims to own, where Denny Nyoni has been selling plots despite failing to establish legal claim to it. Eng Mpange's call for this meeting is also with total disregard that the matter between Kwikbuild and the 49 squatters who bought plots from Denny Nyoni, is still in court. Kwikbuild secured an Order of Possession, on the basis of which it initiated demolition of properties built on its land, subdivision 4300 C, which is itself subject of legal disputes with original owner of Baobab Land. But just after a few of the plots were demolished, Denny Nyoni and Others (of the 49 buyers of plots) rushed to court to obtain a stay of the Order of Possession, ex-parte. Judge Sharon Newa Kaunda granted the ex-parte Order, effectively halting the demolition of structures on the land Kwikbuild says belongs to it. Judge Newa Kaunda also set 15th February, 2025 as the date for inter-parte hearing of the matter between Kwikbuild and Denny Nyoni and the 49 "squatters". But before this hearing is held, Regional Surveyor Eng. Mpange has written to the Officer in Charge of Balmoral Police Station, that all parties involved in the matter should attend a meeting on 13th February, 2025 at the Lusaka Regional Survey Office. In his letter, Eng. Mpange staes: " Reference is made to rhe above subject matter. Further reference is made to your letter dated 3rd February, 2925; therein you requested this office to verify the boundary marks for subdivision C of Farm 4300 (F/4300/C)." He wrote that after "careful analysis of the matter, taking into account our office's previous engagements in respect of F/4300/C, it is our view that a meeting with all parties involved be convened to provide some clarity on the subject matter." The invitation to all parties was issued through the office of the Officer in Charge, Balmoral Police Station. Apart from interferring with the court process involving this matter, the Regional Surveyor's action has complicated the issue for Dr Mahtani's company Kwikbuild by effectively legitimising the claim of the "squatter" who bought plots from Denny Nyoni whose claim of ownership of the land is dubious. Ironically, Kwikbuild Construction itself fighting, Jonathan Van Blerk, the original owner of the land which was compulsorily acquired by the State for public use, but then was given to private companies. Here are some questions for Eng Mpange and the Officer in Charge, Balmoral Police Station: Why has the Regional Surveyor chosen to involve himself in this issue, which is not a boundary dispute, but one of people building on land for which they have no title? For the Balmoral Police Officer in Charge, did he consult officers who accompanied the demolition squad on whose authority they provided security? Alao, what is his interest in requesting the Regional Surveyor's office to verify boundaries? Something smells bad here. Next, we shall publish the full list of the 49 "squatters".
