1. The separate property of an individual partner can be converted into the partnership property u/s.14 of the Partnership Act. Irrespective of the character of the property, if it is brought in to the stock of the firm, it becomes the property of the firm. S.14 enables a partner to bring a property which belongs to him, by the “evidence of his intention” to make it a property of the firm and in order to do so, *_no formal document or agreement would be necessary_*.
2. In the present case, “X” entered into an oral partnership, brought his plot into the firm. Thereafter, he executed a Relinquishment deed of his plot into favour of the firm and got it registered and that’s it. The plot was held to be the property of the firm !!
(For the property dealers, forget GPA Sales, try S.14 of the Partnership Act to avoid stamp duty 😈)
